Simple assault is a misdemeanor for an unwanted touching or threat that causes little or no injury. It becomes felony, or aggravated, assault when a dangerous weapon is involved or the victim suffers serious bodily injury. The presence of a weapon or a severe injury is what separates a misdemeanor from a felony carrying years in prison.
