# Can I be held without bail in Rhode Island?

Yes, but only in limited situations. In Rhode Island most people charged with a crime have a right to be released on bail, and holding someone with no bail at all is the exception reserved for the most serious offenses, such as murder and certain crimes punishable by life imprisonment. To hold you, the state must prove at a hearing that the proof of guilt is evident or the presumption great, and under the 2026 bail reforms prosecutors must show clear and convincing evidence that you pose an immediate danger to public safety or a genuine flight risk. For nonviolent offenses, release is now the default unless the state proves otherwise.
